What Constitutes Aggravated DWI in New York?
For DWI charges to be considered aggravated, the individual charged must have been driving a motor vehicle while having a blood alcohol content (BAC) level of over .18. The BAC limit for a regular DWI is .08 or above.
What Are the Penalties for Aggravated DWI?
The penalties for aggravated DWI are more severe than those associated with non-aggravated DWI. An individual convicted of aggravated DWI may face a one-year license suspension, jail time and large fines.
Penalties increase if this is an individual’s second or subsequent DWI conviction — aggravated or not. A second DWI within 10 years is considered a felony DWI, and penalties may include up to four years in prison, license suspension for one year and thousands of dollars in fines.
